Both husband and wife commit themselves to reaching an agreement without involving court and both parties agree that there will be no litigation while negotiation is taking place. Personally, I am a huge fan of Collaborative Divorce and I truly believe that if you have to go through a divorce, it is the best way to navigate the process. One of the biggest benefits to Collaborative Divorce is that the husband and wife have the final say over the terms of the dissolution of marital assets, custody, visitation, alimony and other historically contentious issues. This allows the parties to be the true authors of their divorce rather than leaving important terms to the discretion of an unknown third party. Also, because of the use of cooperative techniques and the utilization of the team of Collaborative Professionals, the parties are more likely to come out of a Collaborative Divorce more emotionally healthy than a divorce resolved through protracted litigation. That being said, there are certain situations where Collaborative Divorce or mediation are not practical and we will discuss the pros and cons of each type of resolution with you as it applies to your unique situation.
